Participation Agreement, Release, Assumption of Risk, and Waiver
PLEASE READ CAREFULLY. THIS DOCUMENT MUST BE SIGNED BY A
PARENT/LEGAL GUARDIAN IF THE PARTICIPANT IS UNDER 18 YEARS OF
AGE.
The undersigned (hereinafter referred to as the Participant) or the legal guardian of the below named person under 18 years of age, wishes to participate in classes, training, instruction, or
activities provided by Jotunheim Grappling Club LLC (hereinafter referred to as JGC). This
Participation Agreement, Release, Assumption of Risk, and Waiver (the Waiver) applies to
all aspects of the Participants involvement with JGC, including travel to and from JGC for
activities associated with JGC.
Acknowledgment and Assumption of Risks
The Participant acknowledges that participation in JGC activities involves inherent risks, including but not limited to illness, sprains, fractures, paralysis, permanent disability, or death.
These risks may arise from facility conditions, equipment provided by JGC, the Participants
actions or inactions, or those of others, regardless of adherence to rules and policies. The Participant voluntarily assumes full responsibility for all risks associated with participation in JGC
activities.
Compliance with Policies and Procedures
The Participant confirms they have read, understood, and agree to abide by all JGC policies and
procedures. Safe participation depends on strict adherence to these guidelines. The Participant
commits to following all JGC rules, regulations, and policies.
Infectious Disease Protocols
The Participant acknowledges the presence of infectious diseases in the United States and
agrees not to visit or use JGC facilities if experiencing symptoms such as fever, cough, or
shortness of breath, or if they have a suspected or confirmed case of an infectious disease. The
Participant will notify JGC immediately if these restrictions apply. The Participant understands
that, despite JGCs efforts to mitigate risks, participation may result in exposure to infectious
diseases, potentially leading to quarantine, serious illness, disability, or death.
Health, Hygiene, and Safety Requirements
For the safety of the Participant and others, the Participant agrees to comply with the following
health, hygiene, and grooming requirements:
• Maintain personal cleanliness (daily bathing, brushing teeth, using deodorant, etc.).
• Wash hands after eating or using restrooms.
• Keep fingernails clean and trimmed.
• Secure long hair to prevent injury.
• Ensure clothing and gear are clean; wash workout clothing (including gis and uniforms)
and air out equipment after each use. Do not share equipment.
• Wear clean, dry indoor shoes for weightlifting, cardio equipment, or classes requiring
shoes. Use clean, dry flip-flops in locker rooms or bathrooms. Bare feet are not permitted
in bathrooms.
• Remove all jewelry during training.
• Cover open sores or cuts during training. Immediately address any cuts, blisters, or
bleeding, stopping participation until the wound is bandaged. Report blood or similar
substances on surfaces to an instructor or employee for immediate cleaning.
• Report any injuries sustained during training to an instructor or employee immediately.
• Refrain from training if sick or with a suspected or confirmed skin infection or rash.
Consult a doctor promptly if a skin infection is suspected. Refuse to train with anyone
showing signs of infection or open wounds.
• Bathe as soon as possible after training.
The Participant agrees to report any significant hazards observed during participation to an
instructor or employee immediately and will withdraw from participation if necessary.
Health and Fitness Declaration
The Participant represents that they are in good health, with no disabilities, impairments, injuries, diseases, or ailments that would prevent safe participation or increase the risk of injury
to themselves or others. The Participant will not participate while under the influence of alcohol, illegal drugs, or prescription drugs that impair safe participation. The Participant assumes
full responsibility for their use of JGC facilities and activities. A physical examination by a
physician is recommended before beginning any exercise program. The Participant confirms
no medical or physical conditions preclude participation, and no physician has advised against
using JGC or similar facilities.
Release, Waiver, and Indemnification
The Participant hereby releases, waives, discharges, and holds harmless JGC, its affiliates,
predecessors, successors, trustees, officers, directors, employees, agents, and representatives
(collectively, the Released Parties) from any and all claims, suits, liabilities, judgments, costs,
or expenses (Claims) for property damage, loss, theft, personal injury, illness, death, or other
losses arising from participation in JGC activities. The Participant agrees to defend, indemnify, and hold harmless the Released Parties from all defense costs, including attorneys fees,
and any Claims arising from the Participants acts or omissions. The Participant waives any
statutory protections that limit the scope of this release, including unknown future claims. The
Participant is solely responsible for any medical, health, or personal injury costs related to participation. This Waiver is governed by the laws of North Dakota. If any provision is found to
be illegal, invalid, or unenforceable, the remaining provisions remain in full force and effect.
Photo/Video Release
The Participant grants JGC, its representatives, licensees, successors, and assigns permission
to use images, photographs, videos, audio recordings, or drawings of the Participant captured
during activities for any purpose, including promotion, advertising, instruction, or publication.
